It is agreed that the terms set out in the booking form and the wedding pro-forma is the total agreement made between the parties and that no modification of this contract shall be effective unless agreed by both parties in writing.
Special Requests/Coverage
The client understands and accepts that the photographic coverage will be as the Videographers professional expertise determines and that no one scene will be deemed to be more important than another. Special requests are not binding instruction, although every effort is made to comply with the clients wishes.
Any special requests not notified on the booking form must be made by the client to Vivid Memories in writing.
The Videographer
On occasion and without notice it may be necessary for the Videographer/s originally specified to be substituted by another Videographer/s (e.g. due to ill health).
Images
Vivid Memories will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres, or due to certain types of indoor lighting (such as tungsten or halogen). It is sometimes impossible to record the exact colour as seen by the human eye.
Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of Vivid Memories in writing.
Digital Files/Original Tapes
Digital files and original tapes remain the property of Vivid Memories. Original tapes will be stored for up to 12 months after the date of the wedding. If the client wishes for the original tapes to be stored for a further period of time then this can be arranged at a cost of £30 per year.
DVD Life
Although Vivid Memories use up-to-date DVD burning equipment it should be recognised that the DVD may degrade in quality over time or with excessive use. It is recommended that one copy of the DVD is kept by the client in good condition to avoid disappointment in the future. Once the completed DVD has been presented to the client and checked for quality the correct storage and use of the DVD is the responsibility of the client.
Licence
The Videographer shall be granted complete artistic licence including in relation to the scenes captured and the locations used. The Videographers judgement regarding the locations and scenes captured shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all scenes requested.
Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Previews
Although the Videographer will do their best to produce more footage than set out in the agreement, there is no guarantee that any particular amount of footage/scenes will be produced.
Display
It is understood that a wedding is a private event and as such Vivid Memories will not use any scenes or examples from the DVD for advertising purposes without express permission from the client.
The terms of the agreement cannot be changed unless agreed by all parties in writing.
